Article 1. Using the website

If the website offers an extra secure environment, you must first register to use all the functionalities of the website. After your registration has been completed and your account has been approved, if necessary, by Oud-Stratum Dentists, you can log into your account immediately and make full use of the services offered.

If you have an account, you must protect access to your account from unauthorised persons by means of the username and password. In particular, you must keep the password strictly confidential. Oud-Stratum Dentists may assume that everything that happens with your account after logging in with your username and password is under your direction and supervision. You are therefore liable for all such actions unless you have notified Oud-Stratum Dentists that another person knows your password.

If necessary for the service you have requested, Oud-Stratum Dentists may request additional identifying information from you before providing the requested service.

Article 2. Rules of use

It is prohibited to use the website for activities and/or conduct that violate Dutch or other applicable laws and regulations or public order and morality.

If Oud-Stratum Dentists finds that you are in violation of the above terms and conditions, or receives a complaint to this effect, it will give you a warning. If this does not result in an acceptable resolution, Oud-Stratum Dentists itself may intervene to end the violation. In urgent or serious cases, Oud-Stratum Dentists may intervene without warning.

If, in the opinion of Oud-Stratum Dentists, a nuisance, damage or other danger occurs to the functioning of the computer systems or the network of Oud-Stratum Dentists or third parties and/or to the provision of services via the internet, in particular due to excessive sending of emails or other data, leaks of personal data or activities of viruses, Trojans and similar software, Oud-Stratum Dentists is entitled to take all measures it reasonably deems necessary to avert or prevent this danger.

Oud-Stratum Dentists is at all times entitled to report any criminal offences detected. Furthermore, Oud-Stratum Dentists is authorised to provide your name, address, IP address and other identifying information to a third party who complains that you are infringing its rights or these terms and conditions, provided that the accuracy of such complaint is sufficiently plausible in all reasonableness, there is no other way to obtain such information, and the third party has a clear interest in the provision of the information.

Oud-Stratum Dentists reserves the right to recover from you any damages resulting from violations of these terms and conditions.

Article 3. Availability and maintenance

Oud-Stratum Dentists actively maintains the website. If maintenance is expected to limit availability, Oud-Stratum Dentists will perform it when the number of visitors is relatively low. Maintenance due to emergencies can take place at any time.

3.2
Oud-Stratum Dentists may from time to time modify the website and the functionalities on the website.

Article 4. Intellectual property

4.1
The website, related software as well as all information and images on the website are the intellectual property of Oud-Stratum Dentists or its licencors. These may not be copied or used in any way without separate written permission from Oud-Stratum Dentists, except as permitted by law.

Article 5. Duration and termination

Once you have created an account, you enter into an agreement with Oud-Stratum Dentists. This agreement is valid indefinitely and gives you the right to use the services on the website subject to these terms and conditions.

5.2
You may terminate the agreement at any time with immediate effect by notifying Oud-Stratum Dentists by email.

5.3
Oud-Stratum Dentists is entitled to terminate the agreement if you have not used your account for eighteen months. In that case, you will first be sent a reminder email to the email address associated with your account.

Article 6. Changes in prices and conditions

6.1
Oud-Stratum Dentists may amend these terms and conditions at any time.

6.2
Oud-Stratum Dentists will announce changes or additions to these terms and conditions via the website at least fourteen days before they take effect, so that you can take note of them. Changes of minor importance will take effect without prior notice.

6.3
If you do not wish to accept an amendment or addition, you may terminate the agreement up to the date it becomes effective. Use of the website after the effective date constitutes acceptance of the amended or supplemented terms and conditions.

Article 7. Other provisions

7.1
These terms and conditions are governed by Dutch law.

7.2
To the extent not otherwise required by the rules of mandatory law, all disputes related to the website will be submitted to the competent Dutch court for the district in which Oud-Stratum Dentists is located.

7.3
If you request an eConsult or repeat prescription through Oud-Stratum Dentists, it is subject to the 2007 Online Physician-Patient Contact Guidelines. You can view these guidelines upon request, or download them from the KNMG website.

7.4
If any provision of these terms and conditions is found to be invalid, this will not affect the validity of the terms and conditions as a whole. In this case, the parties will determine one or more new provisions to replace the invalid provision or provisions which will reflect the intention of the original provision as much as legally possible.

7.5
Oud-Stratum Dentists is entitled to transfer its rights and obligations under the agreement to a third party who takes over the website or the relevant business activity from it.

7.6
Deviations from these terms and conditions will only be binding if accepted in writing by Oud-Stratum Dentists.
